Applies to stand-alone hosting accounts, as well as, website package accounts.
Legal
Create-A-Website does not warrant that the functions contained in these web
pages or the Internet website will be uninterrupted or error-free. In no
event will Create-A-Website be liable to the client or any third party for
any damages, including any lost profits, lost savings or other incidental,
consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if Create-A-Website
has been advised of the possibility of such damages. Third Party software
applications/programs, such as those found within the web hosting control panel,
or ones suggested by Create-A-Website, are provided as a value-added service
and Create-A-Website will not be held responsible for any problems that may
arise when using Third Party software. Create-A-Website does not provide
technical support on any Third Party software...we suggest you contact the
manufacturer of the product.
If any provision of this agreement shall be unlawful, void, or for any reason
unenforceable, then that provision shall be deemed sever able from this agreement
and shall not affect the validity and enforceability of any remaining provisions.
Copyrights and Trademarks
The client represents to Create-A-Website and unconditionally guarantees
that any elements of text, graphics, photos, designs, trademarks, or other
artwork furnished to Create-A-Website for inclusion in web pages are owned
by the client, or that the client has permission from the rightful owner to
use each of these elements, and will hold harmless, protect, and defend Create-A-Website and its subcontractors from any claim or suit arising from
the use of such elements furnished by the client.
Laws Affecting Electronic Commerce
From time to time, governments enact laws and levy taxes and tariffs
affecting Internet electronic commerce. The client agrees that the client
is solely responsible for complying with such laws, taxes, and tariffs, and
will hold harmless, protect, and defend Create-A-Website and its subcontractors from any claim, suit, penalty, tax, or tariff arising from
the client's exercise of Internet electronic commerce.
Restrictions On Use
This site is maintained by Create-A-Website. You may not modify, copy,
reproduce, republish, upload, post, transmit, or distribute in any way any images or
material from this site including HTML, Java, JavaScript, or CGI code without the
express written consent of a Create-A-Website officer.
Disclaimer
Create-A-Website has provided links to other WWW sites in an effort to make our
site more user friendly. Create-A-Website does not warranty that the functions
contained in the linked materials will be uninterrupted or error-free, that defects will
be corrected, or that these sites or servers, are free of viruses. You, and not
Create-A-Website, assume the entire cost of all necessary correction, maintenance, or repair. Furthermore, Create-A-Website is NOT responsible if
client provides unethical web content (ex. someone else's banner or image).
Limitation of Liability
Under no circumstances shall Create-A-Website be held liable for any direct,

liable for the offensive or defamatory demeanor of any user. If you are dissatisfied
with any Create-A-Website product, advertising, consultation, etc., or with any of
the Create-A-Website legal notices, your mission should be to discontinue
viewing www.createawebsite.net.
Payment Policies
*Payment may be made by ordering on-line with Visa,
MasterCard, or American Express. You may mail a check or money order, and of course, order
over the telephone.
Design: Payment terms require that 1/2 of the total job/service cost be
paid in advance. After the client has approved the website Splash
Page, the
remaining job cost balance will be due Net 30.
Site Maker Pro: Total
cost is required in advance. Once payment has been received, your
account will be activated. Monthly options are
available via debit card only. This service
is non-refundable.
Content Manager: Total
cost is required in advance. Once payment has been received, your
account will be activated. Monthly options are
available via debit card only. This service
is non-refundable.
Hosting: Total cost is required in advance. Once payment has been
received, your account will be activated. Monthly options are
available via debit card only. If you are not completely satisfied with
our hosting services within the first 30 days of your contract, you will be given a full
refund of the hosting contract amount, excluding setup fees.
Best Cart (all versions): Total
cost is required in advance. Once payment has been received, your
account will be activated. Monthly options are
available via debit card only. This service
is non-refundable.
Web Marketing Services: Total cost is required in advance. Once payment has
been received, we will perform your website marketing needs. This service
is non-refundable.
Domain Name Registration: Total cost is required in advance. Once payment has
been received, your domain name will be registered. This service
is non-refundable. Customer is responsible for domain renewals
and updating contact information with Create-A-Website.
Create-A-Website is not responsible for domain names, registration of
domain names, information associated with domain names, domain renewals,
and contact information associated with a domain name. Customer
understands that domain names and information associated with domain
names can be viewed on the Internet.
*If you
pay by check and your check is returned for insufficient funds or you stop payment
on a check, you will be charged a $25 service fee.
